Terms of Service

1. Agreement to Terms

By accessing or using the FireCoach AI platform (“FireCoach,” “the Service,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not access or use the Service.

These Terms apply to all users of the platform, including individual subscribers, team administrators, and enterprise customers. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.

2. Service Description

FireCoach is an AI-powered sales roleplay and coaching platform. The Service includes:

  • AI Practice Sessions: Simulated sales calls (cold calls, discovery, demos, objection handling, and closing) with AI-powered buyer personas
  • Performance Scorecards: Automated scoring and coaching feedback on roleplay sessions
  • Team Management: Tools for managers to assign practice scenarios, track rep performance, and manage team access
  • Methodology Builder: Tools to encode your sales process into AI-scored rubrics
  • CRM Integrations: Connections with HubSpot, Salesforce, and other platforms (where available)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where practicable.

3. User Accounts

To access FireCoach, you must create an account. You agree to:

  • Provide accurate, current, and complete account information
  • Maintain and promptly update your account information
  • Keep your password confidential and not share access credentials
  • Notify us immediately at hello@firecoach.ai of any unauthorized use of your account

You are responsible for all activity that occurs under your account, whether or not authorized by you. FireCoach is not liable for any loss resulting from unauthorized use of your account.

4. Acceptable Use

Permitted Use: FireCoach is licensed for legitimate sales training and skill development, including team practice sessions, performance coaching, scenario building, and integration with your CRM and sales tools.

Prohibited Use. You agree not to:

  • Resell, sublicense, or provide access to the Service to third parties outside your organization without written permission
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the platform
  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Misrepresent your identity, affiliation, or purpose when using the Service
  • Use automated tools to scrape, crawl, or extract data from the platform
  • Upload or transmit content that is harmful, offensive, or violates the rights of others
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure

Violation of these terms may result in immediate suspension or termination of your account.

5. Subscription & Billing

FireCoach is offered on a subscription basis, billed monthly or annually depending on the plan you select at the time of signup.

  • Billing: Your subscription will be billed at the start of each billing period. Payments are processed by Stripe.
  • Renewals: Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds: Subscription fees are generally non-refundable except as required by applicable law. If you believe a billing error has occurred, contact hello@firecoach.ai within 30 days.
  • Price Changes: We will provide at least 30 days’ notice before implementing any price changes to your current plan.

6. Your Content

You retain ownership of your content. This includes your pitch decks, roleplay scenarios, scorecards, call recordings, sales methodology documentation, and any other materials you upload to FireCoach (“Your Content”).

By uploading or submitting Your Content to FireCoach, you grant us a limited, non-exclusive license to process, store, and display Your Content solely as necessary to provide the Service to you. This license does not extend to:

  • Training AI models that are made available to other customers or the general public
  • Sharing Your Content with other organizations
  • Using Your Content for any purpose beyond delivering the Service to your account

You are responsible for ensuring that Your Content does not infringe on third-party rights or violate any applicable laws.

7. Intellectual Property

FireCoach’s IP: The FireCoach platform, including all software, AI models (other than those trained on Your Content), user interfaces, designs, text, and graphics, is owned by FireCoach AI Inc and protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works based on the platform.

Your IP: As stated in Section 6, you retain all intellectual property rights to Your Content.

8. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • FIRECOACH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
  • OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for consequential damages, so the above limitations may not apply to you.

9. Termination

By You: You may cancel your subscription and terminate your account at any time through your account settings or by contacting hello@firecoach.ai. Cancellation takes effect at the end of your current billing period.

By Us: We may suspend or terminate your account for material violations of these Terms, with or without prior notice depending on the severity of the violation. We will make reasonable efforts to notify you and provide an opportunity to remedy non-material violations before terminating.

Data After Termination: Following account termination, Your Content will be deleted from our systems within 30 days, except where retention is required by law. We recommend exporting any data you need before cancelling your account.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
